INFORMATION NOTE

This information note provides you with detailed information regarding the protection of your personal data in the context of the provision, by VIPMED INTERNATIONAL S.R.L. („Vipmed” or „We”), headquartered at str. Drumul Gura Siriului, no. 65A, et. 3, ap. 18, Sector 3, Bucharest, having the unique registration code no. 21752464 and the order number in the Trade Register J40/9526/2007, of services for obtaining a secondary medical opinion regarding your medical case, for validating your diagnosis, or for ensuring your transportation to the locations of our partners.

We are responsible, as an operator, for processing your personal data within our activities. Through this note, we inform you about the personal data we use, the intended purpose, the categories of recipients to whom we transmit this data, the duration of their storage, and how you can exercise the rights granted by law regarding data processing.

 

PURPOSES OF PROCESSING YOUR PERSONAL DATA

We process your personal data for the purpose of concluding and executing the service provision contract. For this purpose, we process the following categories of data:

  • Identification information (e.g., name, surname, date of birth, series and number of identity document, signature, copy of passport – when applicable, copy of insurance policy – when applicable);
  • Contact information (e.g., postal address and email address, phone number);
  • Special categories of personal data (e.g., analysis reports, health status, biological samples).

Identification information is necessary for completing and concluding the service provision contract, for ensuring your transportation, and for ensuring accommodation at our partners’ locations.

Contact information is used for sending documents necessary for concluding, executing, or terminating the service provision contract, for communicating secondary medical opinions, and for sending any other necessary communications related to the requested services.

Special categories of data are processed for creating a medical summary and for obtaining secondary medical opinions or confirmation of your diagnosis.

Your data will not be processed for any other purpose than those mentioned above.

If you refuse to provide us with all the necessary data, we will find ourselves in the situation where we will not be able to provide the requested services.

 

STORAGE DURATION

If, after transmitting the data, you conclude a service provision contract with Us, we will retain your personal data for the duration of the contract’s execution. Subsequently, we will continue to process your data in compliance with the principle of minimization and purpose limitation, if we are required by a legal provision (e.g., keeping documents, records, and accounting registers for a period of 5 or 10 years) or if we have a legitimate interest (e.g., for audit purposes or when such information is necessary for investigations or legal actions).

We will ensure the deletion of your data when its storage is no longer supported by any of the above processing grounds.

If, after transmitting the data, you do not conclude a service provision contract with Us or our Partners, we will delete your data immediately, but no later than 3 years from the date you provided it to us.

 

DATA RECIPIENTS

Since specialized medical consultations are provided by doctors from clinics abroad, your data may be transferred abroad, respectively to: Austria, Germany, France, Switzerland, Turkey, and the United States of America (as applicable).

The territories outside the European Union to which we transmit your data may have different, and sometimes lower, data protection standards.

To protect the confidentiality and security of biological samples and personal data, and to reduce any risk during the period they are in the United States of America/Turkey/Switzerland, we have implemented appropriate measures so that biological samples and personal data are protected and processed in a secure manner.

For the provision of the requested services, your data may also be transmitted, as applicable, to translation agencies, travel agencies, companies that provide patient transportation, or competent authorities.

Your data may also be accessible to IT service providers necessary for the operation and security of our IT systems.

Additionally, Vipmed may be legally required to disclose your data if this is necessary for establishing, exercising, or defending Our rights before the competent authorities.

 

WHAT ARE YOUR RIGHTS AND HOW CAN YOU EXERCISE THEM?

In accordance with Regulation (EU) 2016/679 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, you have, under certain conditions, the following rights:

  • Right of access to data: you can obtain information regarding the processing of your personal data and a copy of these personal data.
  • Right to rectification of data: if you consider that your personal data is inaccurate or incomplete, you can request the corresponding modification of these personal data.
  • Right to obtain data deletion: you can request the deletion of your personal data, to the extent provided by law.
  • Right to restrict processing: you can request the restriction of the processing of your personal data.
  • Right to object to processing: you can contest the processing of your personal data, for reasons related to your particular situation. You have an absolute right to object to the processing of your personal data for direct marketing purposes, which includes profiling related to such direct marketing.
  • Right to data portability: you have the right to request that the personal data you have provided be returned to you or, if possible, be transferred to a third party.

Additionally, regarding the data processed based on your consent, you have the right to withdraw your consent at any time, without affecting the lawfulness of the processing carried out by Us before your withdrawal.
